BLX Elite Transportation LLC

These Terms & Conditions (“Terms”) govern your use of the website (“Site”) and transportation services (“Services”) provided by BLX Elite Transportation LLC (“Company,” “we,” “us,” or “our”).

BY BOOKING OR USING OUR SERVICES, YOU AGREE TO THESE TERMS.

1. Eligibility & Age Requirements

• Services are intended for individuals 21 years of age or older.

• Individuals under 21 may only use the Services if booked by a parent, legal guardian, or responsible adult.

• Any passenger under 18 years old must be accompanied by a parent, legal guardian, or responsible adult at pickup and drop-off, unless otherwise agreed in writing.

• By booking, you confirm that all provided information is accurate and that you meet these requirements.

2. Booking & Service Terms

• All bookings must include accurate:

  • Full name

  • Contact information

  • Pickup and drop-off locations

  • Date and time of service

• You agree that all information provided is true and complete.

• We reserve the right to refuse or cancel any booking for:

  • Safety concerns

  • Incomplete or false information

  • Violation of these Terms

• Delays caused by incorrect or incomplete information are the responsibility of the customer.

3. Payment Terms

• A $60 non-refundable deposit is required per vehicle (“truck”) at the time of booking to secure your reservation.

• Rescheduling Policy:
  You may reschedule your ride up to 48 hours (2 days) prior to your scheduled service. The rescheduled ride must occur within 30 days of the original booking date.
  Failure to reschedule within this timeframe will result in forfeiture of your deposit.

• Full payment must be completed at least 24 hours prior to the scheduled ride.

• Accepted payment methods include:

  • Zelle

  • Cash App

  • Apple Pay

• If you intend to pay by credit card, you must notify us in advance by emailing book@blxelite.com so that appropriate arrangements can be made.

• Failure to complete full payment within the required timeframe may result in cancellation of your booking without refund of the deposit.

• Additional charges may apply for:

  • Extended wait times

  • Changes to route or destination

  • Additional stops not included in the original booking

Chargebacks & Payment Disputes

• By submitting payment, you acknowledge and agree to these Terms, including the non-refundable deposit and rescheduling policy.

• You agree not to initiate a chargeback or payment dispute with your bank or payment provider for services that were properly scheduled, reserved, or rendered in accordance with these Terms.

• In the event of a chargeback or payment dispute, BLX Elite Transportation LLC reserves the right to:

  • Provide proof of agreement, booking confirmation, and communication records to the payment processor

  • Permanently ban you from booking future services

  • Refuse all future service requests

  • Recover any unpaid balances, fees, or costs associated with the dispute, including administrative and processing fees, to the fullest extent permitted by law

• Any fraudulent or bad-faith chargebacks may be pursued further, including through collections or legal action, where applicable.

• By booking with us, you acknowledge that all payments made are authorized and agreed upon, and that you understand and accept our policies.

4. Cancellation & No-Show Policy

• Cancellations must be made within the timeframe specified at booking.

• The $60 deposit is non-refundable under all circumstances, except where required by law.

• Late cancellations or no-shows may result in full charges.

5. Passenger Conduct

• Passengers must behave respectfully toward drivers and staff.

• No illegal activity, smoking, or unsafe behavior is permitted.

• No illegal or legal firearms of any kind.

• No weapons of any kind.

• We reserve the right to terminate a ride without refund if:

  • Passenger behavior poses a safety risk

  • Laws are violated

6. Limitation of Liability

To the fullest extent permitted by law:

• BLX Elite Transportation LLC is not liable for indirect, incidental, or consequential damages, including but not limited to:

  • Missed flights, appointments, or events

  • Delays caused by traffic, weather, road conditions, mechanical issues, or unforeseen circumstances

• We do not guarantee exact arrival times.

• Our total liability, if any, shall not exceed the amount paid for the specific service.

7. Assumption of Risk

By using our Services, you acknowledge and accept that transportation involves inherent risks, including but not limited to:

• Traffic accidents

• Road hazards

• Weather conditions

You voluntarily assume all such risks to the extent permitted by law.

8. Liability Waiver & Release

By booking or using our Services, you agree to:

• Release and hold harmless BLX Elite Transportation LLC, its owners, drivers, employees, and affiliates from any claims, liabilities, damages, or expenses arising out of:

  • Use of our Services

  • Passenger conduct

  • Circumstances beyond our control

This waiver applies to the maximum extent allowed under New Jersey law.

9. Personal Property

• We are not responsible for lost, stolen, or damaged personal belongings left in vehicles.

• If an item is found, we will make reasonable efforts to return it.

10. Safety & Law Enforcement Compliance

• All passengers must comply with local, state, and federal laws.

• We reserve the right to cooperate with New Jersey and United States law enforcement authorities, including:

  • Traffic stops

  • Investigations

  • Legal requests

• Information may be disclosed when required by law or for safety purposes.

11. Insurance

• BLX Elite Transportation LLC maintains auto insurance coverage as required by the State of New Jersey.

• Coverage applies strictly in accordance with policy terms, conditions, and limitations.

• Nothing in these Terms shall be interpreted to expand insurance coverage beyond what is provided under applicable policies.

12. New Jersey Compliance

• These Terms are governed by the laws of the State of New Jersey.

• Any disputes shall be resolved exclusively in courts located within New Jersey.

• If any provision is found unenforceable, the remaining provisions will remain in effect.

13. Privacy

Your use of our Services is also governed by our Privacy Policy.

14. Changes to Terms

We may update these Terms at any time. Updates will be posted on our Site with a revised effective date.

Continued use of our Services constitutes acceptance of the updated Terms.

16. Legal Waiver, Release of Liability & Covenant Not to Sue

To the fullest extent permitted by applicable law, by booking or using our Services, you (on behalf of yourself and any passengers in your party) agree to the following:

No Third-Party Insurance Status:

• You acknowledge that passengers are not additional insureds under BLX Elite Transportation LLC’s insurance policies.

• Any coverage maintained by the Company is strictly limited to the terms, conditions, and limitations of those policies.

Release of Liability:

• You hereby release, waive, and discharge BLX Elite Transportation LLC, its owners, members, managers, drivers, employees, contractors, and affiliates from any and all claims, demands, damages, losses, or causes of action arising out of or related to:

  • Use of our Services

  • Transportation-related incidents

  • Accidents, delays, or unforeseen events

  • Acts of other passengers or third parties

Covenant Not to Sue:

• You agree that you will not file, initiate, or participate in any lawsuit, claim, or legal proceeding against BLX Elite Transportation LLC or its representatives for any matter arising out of or related to the Services, except where such limitation is prohibited by law.

Assumption of Risk:

• You understand that transportation services involve inherent risks, including but not limited to vehicle accidents, road conditions, and actions of other drivers, and you voluntarily assume all such risks.

Indemnification:

• You agree to indemnify, defend, and hold harmless BLX Elite Transportation LLC from any claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising from:

  • Your actions or omissions

  • Violation of these Terms

  • Any claims brought by passengers or third parties associated with your booking

Limitation Required by Law:

• Nothing in this section shall limit or exclude liability to the extent such limitation is not permitted under New Jersey law, including for gross negligence or willful misconduct where applicable.

By booking our Services, you acknowledge that you have read, understood, and voluntarily agreed to this waiver and release of liability.

17. Photography & Social Media Consent

• By booking or using our Services, you acknowledge and agree that photos and/or videos may be taken by BLX Elite Transportation LLC or its designated photographers during your service.

• You grant BLX Elite Transportation LLC the right to use, publish, and share such content on social media platforms, marketing materials, and promotional channels without compensation.

• If you do not wish to be photographed or have your image shared, you must notify us in writing prior to your scheduled service. We will make reasonable efforts to accommodate such requests.
